Interdisciplinary Expert Opinion of Prof. Dr. Knut Werner Lange and Prof. Dr. Kay Windthorst    

On behalf of the foundation Family Enterprises the professors Knut Werner Lange and Kay Windthorst examined the possible introduction of a women´s quota and its effects on family enterprises. The expert opinion focuses on Company, European and Constitutional issues.

Prof. Dr. Knut Werner Lange is holder of the chair of Civil Law, German and European Trade and Economy Law at the University of Bayreuth and Director of the Research Centre (Law).

Prof. Dr. Kay Windthorst is holder of the chair of Public Law, Legal Doctrine and Legal Didactics at the University of Bayreuth and Managing Director of the Research Centre.

Legal Requirements for a women´s quota

In the Frankfurter Allgemeinen Zeitung of 15th November 2012 (No. 267, pages 1, 2) the members of the Research Centre stated their position on the legal requirements for the introduction of a mandatory women´s quota. Both scientists explained the legal framework conditions and arrangements on behalf of the foundation Family Enterprises.

The law professors Knut Werner Lange and Kay Windthorst of the University of Bayreuth consider that a statutory  women´s quota is in accordance with the German Constitution and European Law as far as it provides for a series of hardship and exception clauses (page 2).

The expert opinion on the legal admissibility of a mandatory women´s quota, which underlies the article, is forthcoming.
